Please note: if you refuse to grant the above necessary permissions (referring to access permissions for sensors, location, and time information), core functions such as "One-click Star Search" and "Automatic Tracking" within the APP will not function properly.

2. Acuter Sky Terms of Service

(1) Service Content and Scope

The core services provided by this APP include: celestial position calculation based on device sensor data and astronomical algorithms, telescope automatic pointing guidance, and usage assistance content for celestial tracking control. This APP only supports linkage with devices such as telescopes and electric pan-tilts of specified models of the ACUTER brand. Noncompatible devices may not be able to achieve full service functionality, and the specific compatible models shall be subject to the in-APP instructions or official announcements. This APP service mainly operates locally on the device. Some basic astronomical data may be cached locally during the first installation or update, and does not require continuous network connectivity. However, to obtain product help and updated content, a network connection is required.

(2) User Rights and Obligations

1. User Rights

• Service Usage Rights: Subject to compliance with these Terms, you have the right to use the core service functions of this APP free of charge, and may provide feedback through the contact information when you have objections to the service quality.
• Autonomous Permission Management: You can adjust all permissions granted to the APP at any time through the device system settings, and have the right to independently decide whether to uninstall this APP to terminate the service.
• Intellectual Property Ownership: The intellectual property rights of astronomical images, observational data, and other content you capture or record through this APP shall belong to you, and we do not claim any rights.

2. User Obligations

• Obligation of compliant use: When using this APP and linked devices, you shall comply with relevant national regulations on astronomical observation, and shall not use this APP to engage in activities that endanger national security, disrupt public order, or infringe upon the rights and interests of others, nor shall you use telescopes and the APP for observation in areas where photography is prohibited.
• Obligations for Equipment Use: You shall ensure that the telescope and its supporting equipment you use are qualified products purchased through regular channels, and use the APP after proper installation and commissioning. You shall be solely responsible for any personal injury or property damage caused by equipment failure or improper operation.
• Obligations for Permission Usage: You shall reasonably grant device permissions in accordance with the functional requirements of the APP, and shall not tamper with the APP's permission acquisition mechanism through technical means, nor use the sensor data collected by the APP for purposes unrelated to astronomical observations.
• Obligation of Information Authenticity: If you submit information such as consultations or aftersales feedback through the APP, you shall ensure that the content is true and accurate, and shall not provide false information to mislead our service response.

3. Juvenile Protection

If you are a Juvenile under the age of 18, you must use this APP under the supervision of a guardian, and the guardian shall assist in managing device permissions and personal creative content. If the guardian discovers any information security issues during the Juvenile's use, they may contact us immediately, and we will provide necessary assistance.

(3) Intellectual Property Statement

1. Intellectual property rights such as software copyright, interface design, astronomical algorithms, and product help content of this APP are all owned by our company and protected by laws and regulations such as the Copyright Law and the Patent Law.

(4) Service Changes, Interruptions, and Terminations

1. Service Changes: We may adjust the content of the APP service based on technological upgrades, functional optimizations, or legal and regulatory requirements. After the changes, we will notify you through in-APP announcements or update descriptions. If you continue to use the service, it will be deemed that you have agreed to the content of the changes.

(5) Disclaimer

1. Astronomical observations are affected by natural and environmental factors such as weather, geographical location, and light pollution. The celestial body positioning data provided by this APP is calculated based on theoretical algorithms, and the actual observation results may differ from what is shown in the APP. We do not provide absolute guarantees for the accuracy of the observation results.
2. For functional abnormalities caused by device hardware performance limitations, system version incompatibility, or your failure to update the APP in a timely manner, we will provide technical support but will not assume direct responsibility. We recommend that you use devices that meet the APP's operating requirements and keep the APP up to date.
3. In the event of APP data corruption or information leakage caused by malicious attacks from third parties, virus infections, or security vulnerabilities in the user's device itself, we shall not assume relevant liability provided that we have fulfilled our reasonable security obligations.

To implement the core functions of the time-lapse photography APP, namely "shooting timelapse videos" and "controlling the ACUTER electric pan-tilt", we will only collect the device permissions and relevant data necessary for completing the service after obtaining your authorization, as detailed below:

Necessary device permissions and data: Camera permission and captured image data are used to capture continuous image frames required for time-lapse photography, which are then combined to create a time-lapse video. During this process, the camera is only activated when you actively trigger the shooting function, and the image data is directly generated locally on the device.

Bluetooth permissions and device matching data: Used to scan and identify the Bluetooth signals of surrounding ACUTER brand electric pan-tilts, establish a secure connection between the APP and the pan-tilt, and enable the transmission of control commands for parameters such as pan-tilt rotation speed and shooting angle. During the connection process, only the model identification information of the pan-tilt device is collected for matching verification.

Please note: If you refuse to grant camera permissions, the core shooting function of the Timelapse Photography APP will not be available; if you refuse to grant Bluetooth permissions, it will affect the linked control function with the ACUTER Electric Gimbal.

(3) Storage and Sharing of Personal Information

Storage Method and Scope: All image and video content captured through this APP, as well as device pairing records generated during the Bluetooth connection process, are only stored in the local storage area of the device where you installed this APP (such as the phone photo album or app-specific folder), and will not be transmitted to any server or cloud node outside the device.

Sharing and Disclosure Restrictions: We are committed to not sharing, transferring, or publicly disclosing your captured image data and device Bluetooth pairing information with any third parties. All data is only used for specified purposes within the APP, such as time-lapse photography creation and gimbal control command transmission, with no other derivative use cases.

(4) Personal Information Protection

We will not actively collect any of your private data through the time-lapse photography app. All device permissions are obtained strictly in accordance with the principles of "minimum necessity" and "user-initiated authorization." Locally stored image data is protected by your device's own security mechanisms (such as password locks and biometric recognition), and we will use technical means to prevent risks such as permission abuse and data leakage within the app itself.

2. Terms of Service for Acuter Landscape Application

(1) Service Content and Scope

Core Services: Provide you with time-lapse photography parameter settings (such as shooting interval, duration), image capture and synthesis, wireless connection and remote control services for the Aikanda brand electric pan-tilt, and assist in completing time-lapse photography creation for scenes such as landscapes and architecture. The pan-tilt connection and control function requires enabling the device's Bluetooth and keeping the APP running in the background; if you need to obtain value-added content such as pan-tilt firmware updates and shooting tips, you need to maintain a network connection.

Compatibility Range: This APP only supports linkage with specified models of ACUTER brand electric pan-tilts. Non-compatible models of pan-tilts may experience issues such as connection failure and control delay.

(2) User Rights and Obligations

User Rights

• Service Usage Rights: Subject to compliance with these Terms, you have the right to use the core shooting and gimbal control functions of this APP free of charge, and may submit improvement suggestions for service defects through official channels.
• Ownership of Works: For time-lapse video works shot or synthesized through this APP, the intellectual property rights belong to you, and you may lawfully exercise rights such as reproduction, dissemination, and display (subject to relevant laws, regulations, and third-party rights provisions).
• Permission Management and Service Termination Right: You may adjust the camera and Bluetooth permissions of the APP at any time through the device system settings, and you may also terminate all services by uninstalling the APP.

User Obligations

• Compliance Creation Obligations: When using this APP to take photos, you shall comply with laws and regulations such as the Copyright Law of the People's Republic of China and the Law on Public Security Administration Punishments, and shall not photograph state secret sites, others' private spaces, or illegal and non-compliant content such as pornographic or violent content. • Obligations for Equipment Use: You shall ensure that the ACUTER electric pan-tilt you use is a qualified product purchased through regular channels. Before use, you need to read the pan-tilt instruction manual and correctly pair it. You shall be solely responsible for any equipment damage or property loss caused by equipment quality issues or improper operation.
• Data Security Obligations: You shall properly safeguard your device and locally stored image data. If the image data is illegally obtained due to device loss, theft, or password leakage, we shall not assume any related liability.
• Juvenile Protection: If you are a Juvenile under the age of 18, you must use this APP under the supervision of a guardian, and the guardian shall assist in managing device permissions and personal creatives. If a guardian discovers any information security issues during the Juvenile's use, they may contact us immediately, and we will provide necessary assistance.

(3) Intellectual Property Statement

After the change, we will notify you through an in-app announcement. If you continue to use the service, it will be deemed that you have agreed to the changed content.
• Service Interruption: In the event of a temporary service interruption caused by factors such as Bluetooth signal interference, device system version incompatibility, or APP maintenance, we will notify the cause of the fault and the repair progress through an APP pop-up window. We will not be liable for any impact on shooting plans during the interruption period.
• Service Termination: If you violate core agreements such as the "Obligation of Compliant Creation" in these Terms, we reserve the right to suspend or terminate the service; if the APP ceases operation due to business adjustment, we will announce through APP pop-up window and official channels at least 30 days in advance, clearly specifying the service termination time, during which you may export your local image data.

(5) Disclaimer

• Time-lapse photography effects are influenced by various factors such as lighting conditions, environmental stability, and device hardware performance. This APP only provides technical function support and does not make absolute guarantees regarding the image quality or effects of the captured works.
• For gimbal control delays, connection interruptions caused by interference from third-party devices or limitations of Bluetooth transmission distance, or malfunctions caused by issues with the gimbal's own firmware, we will provide technical troubleshooting suggestions but will not assume direct responsibility. You may contact the gimbal's after-sales department for handling.
• If the image and video content you capture and disseminate through this APP has issues such as infringement or illegality, you shall bear the legal liability arising therefrom. We reserve the right to cooperate with relevant departments in investigations after receiving a legal notice.
• We shall not be liable for breach of contract if the APP service cannot be provided normally due to force majeure (such as natural disasters, network outages).

Storage: Your precise geolocation data is only computed in real-time locally on the device during app usage, or may be cached locally in an anonymous and encrypted form to improve the speed of the next startup. We will not create a database on our servers that contains your personal identity and location history.
